Oh God, Mark Cuban's being a jackass again

I love Mark Cuban. Seriously, he brought my second all-time favorite sports franchise out of the utter doldrums of its respective league and made it into a prenniel winner, a contender. This fact makes it easier to swallow his dancing, haircuts, tight shirts and erratic behavior.

Then he goes off and sues former coach Don Nelson for having "confidential information" which led to Nelson's new team, Golden State, beating the No. 1 seed Mavs in the first round of the playoffs.

You have got to be freakin' kidding me!

I don't need the nation to love the Mavs like I do, but it makes it very hard for anyone to respect the Mavs when the owner is bringing up bullshit lawsuits (in this, the days of tort abuse) about Nelson having information which led, I guess, to the Warriors having a bigger basket. Or Dirk shitting a brick.

This all stems from Nelson demanding $6.5 million in back payments, which Cuban said Nelson shouldn't get because he violated the non-compete clause when he took the Golden State job. Nelson said he took the Golden State job because Cuban quit paying him.

Then there was the pre-playoff party that Nelson hosted in Oakland that included Mavs coaches Avery Johnson and Del Harris.

Speaking of Harris, remember he's still a big buddy of Nelson's who recently was taken off the bench staff and put behind a desk as a consultant (he said he "retired" -- yeah, right". Does he have anything to do with this "confidential information?" Also remember that it was Harris who was the go-between with Cuban and Nelson during The Break-Up. He literally passed notes between the feuding pair.

Then Nelson's son, Donnie, is the Mavs GM. Jesus, does this get any more complicated? Seems like a big jack-ass party and everyone's invited.

Um, Cubes, my Spurs now have 4 more titles then your Mavs.

But I believe you currently lead us in frivolous lawsuits.

This is really weak Chip's Moody Blues.

I read the Star Telegram article, and apparently the only person Eddie Sefko talked to was Don Nelson's lawyer. Did it occur to you that Nellie's lawyer might possibly be characterizing that counter-claim in such a way to make his client look good and Cubes look bad? He didn't even bother to hold his article until getting a reaction from Cuban. That's a basic principle of journalistic fairness.

What Nellie's lawyer may indeed be true, and if it is, Cuban's an ass, but he's not the final authority for this litigation, the arbitrator is.

Would you make a blog post giving a forum to Mark Cuban's characterization of Don Nelson's faults and why he doesn't deserve to prevail in their dispute? The only "evidence" we have for this claim is Nellie's lawyer, hardly an unbiased and objective source. You're running with a polemic from Nelson's side, which is not the same thing as evidence.

Irresponsible and sloppy on your part.

Secondly, Eddie Sefko is the beat writer for the Dallas Morning News, which is in direct competition with the Fort Worth Star Telegram. I guess if Sefko wrote for the FWST, the Morning News could sue him for violating a non-compete clause.

Shouldn't you write Jeff Caplan, the writer of the story?

And Cuban has been notoriously silent since the playoffs. He's probably been thinking up this lawsuit.

My mistake, I was referring to the article that Sefko wrote. However, one thing they both rely on for the basis of their story is the word of Nellie's lawyer alone. It might very well be true but it's pretty weak sauce. I don't think one side in a legal dispute gets a monopoly on the facts or that we should just take their word for it. That's my only beef. Your blog entry is based on the assumption that this is indeed settled fact, and not just the statement of a lawyer whose job it is to cast Nellie's position in the best possible light and make Cubes look as bad as possible. If you had used words like "allegedly" or "according to" I wouldn't feel compelled to comment.

Does it pass the smell test? It makes the Mavericks organization look dysfunctional and run by Howard Hughes. The negative publicity alone from the stories today don't make it worth it to pursue this counterclaim. And it's just as likely that "inside information" is just legal jargon related to the no-compete clause. Say whatever you want about him, but one thing you can't say about Cuban is that he's dumb. And suing a guy for beating you in the playoffs is dumb. It might be true, but I need more than Nellie talking to Eddie Sefko or Jeff Caplan to make it so. Other than that, I wish you well with your blog and Go Mavs!
